1.) As used herein, the term "bid price" means the price at which a lot is successfully sold to the highest bidder. The term
"purchase price" means the aggregate of the bid price and buyers premium if applicable.
2.) The highest bidder shall have purchased the offered lot at the fall of the Auctioneers hammer, when the Auctioneer
says “sold” or in the case of a simulcast auction the Internet Auctioneer closes the item offered and moves to the next lot
in the order of the sale. At which time legal transfer of ownership of the item occurs at that time and the high bidder
agrees to pay the bid price, buyers premium (if applicable) and tax on each item purchased. The purchaser in
accordance with all of the conditions set forth herein (a) assumes full risk and responsibility therefore, (b) if requested
will sign a confirmation of purchase, and (c) will pay the purchase price in full or such part as we may require for all lots
purchased. No lot may be transferred. If the foregoing conditions or any other applicable conditions herein are not
complied with, in addition to other remedies available to us and the consignor by law, including without limitation, the
right to hold the purchaser liable for the purchase price, we at our option may either (a) cancel the sale, retaining as
liquidated damages all payments made by the purchaser or (b) resell the property, either publicly or privately, and in
such event the purchaser shall be liable for the payment of any deficiency plus all costs and expenses of both sales, our
commission at our standard rates, all other charges due hereunder, attorneys’ fees and incidental damages. If all fees,
commissions, bid price and other sums due to us from the purchaser are not paid promptly as provided in these
Conditions of Sale, we reserve the right to impose a finance charge equal to 2% per month on all amounts due to us
beginning on the 31st day following the sale until payment is received, in addition to other remedies available to us by
law.
3.) Preview is strongly suggested whether bidding live or on the Internet. Although our descriptions are guaranteed to be
accurate items are sold “as-is-where-is” with no guarantees or warrantees as to condition are expressed or implied. Any
representations of the product are between the seller and the buyer. When you are the successful bidder, you have
affected a contract and will be expected to pay for the items in which you are the successful bidder. Absolutely no
refunds or exchanges. Once you buy it you own it.
4.) All statements contained in the catalog or in any bill of sale, invoice or elsewhere as to authorship, period, culture,
source, origin, measurement, quality, rarity, provenance, importance, exhibition and literature of historical relevance, or
physical condition ARE QUALIFIED STATEMENTS OF OPINION BY THE CONSIGNOR AND NOT REPRESENTATIONS
OR WARRANTIES. No employee or agent of Winning Run Auctioneers is authorized to make on our behalf or on that of
the consignor any representation or warranty, oral or written, with respect to any property.
5.) In accordance with A. R. S. 47-232847-2328. Sale by auction
A. In a sale by auction if goods are put up in lots each lot is the subject of a separate sale.
B. A sale by auction is complete when the auctioneer so announces by the fall of the hammer or in other customary
manner. Where a bid is made while the hammer is falling in acceptance of a prior bid the auctioneer may in his
discretion reopen the bidding or declare the goods sold under the bid on which the hammer was falling.
C. Such a sale is with reserve unless the goods are in explicit terms put up without reserve. In an auction with reserve
the auctioneer may withdraw the goods at any time until he announces completion of the sale. In an auction without
reserve, after the auctioneer calls for bids on an article or lot, that article or lot cannot be withdrawn unless no bid is
made within a reasonable time. In either case a bidder may retract his bid until the auctioneer's announcement of
completion of the sale, but a bidder's retraction does not revive any previous bid.
D. If the auctioneer knowingly receives a bid on the seller's behalf or the seller makes or procures such a bid, and
notice has not been given that liberty for such bidding is reserved, the buyer may at his option avoid the sale or take the
goods at the price of the last good faith bid prior to the completion of the sale. This subsection shall not apply to any bid
at a forced sale.
6.) If a lot is offered subject to a reserve, we reserve the right to bid on behalf of the consignor, whether by opening the
bid or continuing to bid on behalf of the consignor in response to other bidders until reaching the pre determined
reserve price. If we have an interest in an offered lot and the proceeds thereof other than our commissions, we may bid
therefore to protect such interest. CONSIGNORS MAY NOT BID ON THEIR OWN ITEMS OR CONSPIRE WITH ANOTHER
PERSON TO BID ON THEIR BEHALF OTHER THAN THE AUCTIONEER OR PERSON DESIGNATED BY AUCTIONEER
EMPLOYED BY AUCTION COMPANY.
7.) We reserve the right to reject a bid from any bidder. In the event of any dispute between bidders, or in the event the
auctioneer doubts the validity of any bid, the auctioneer shall have sole and final discretion either to determine the
successful bidder or to re-offer and resell the article in dispute. If any dispute arises after the sale, our sales records
shall be conclusive in all regards.
8.) EVERYTHING MUST BE PAID IN FULL ON THE DAY OF THE AUCTION regardless of when it is picked up. Phoenix
metro buyers must pick up their items on the day of the auction or on the first business day following the auction from
9am - 5pm. Items that are being shipped will be shipped on the first business day following the auction – buyers will be
charged for their purchases on auction day and charged for shipping on the second business day following the auction.
We reserve the right to withdraw any property at any time before the actual sale.
9.) All purchased property shall be removed from the premises at which the sale is conducted by the date(s) and time(s)
as advertised or announced the day of the sale for that particular auction event. Winning Run Auctioneers will
automatically ship out of state Internet purchases unless notified in advance of the auction date not to ship. Arizona
buyers MUST PICK UP auction day or first business day after the auction at no extra fee or charge. For every day after
that day a storage fee of $7 per day, per lot will be assessed to each lot not picked up or claimed. If items are not picked
up within 7 days from the date of the auction, the items will be considered abandoned and the buyer shall forfeit the item
(s) along with any deposits or payments made on the items. Abandoned items will be disposed of at our discretion. If
Arizona buyers provide advance notice, we will be happy to ship at the regular rates as indicated in the terms of the
auction. Regardless any auction product that is not removed or shipped within 7 days after the auction will be forfeited.
10.) Invalid or unapproved credit card purchases will be subject to a $50 processing fee for late payment if paid on the
first business day following the auction. If the auction proceeds are collected later than the following business day after
an auction, an additional daily fee will be added of $10 per day. Failure to pay within seven days of the end of the
auction will ban the bidder from participating in any online auction.

Live Auction
The following Conditions of Sale apply to all auctions, Internet, Live or simulcast. Posted notices
or verbal announcements made by the auctioneer before or during the sale shall take
precedence over any previous advertisements, notices, handbills or printed material. The
following constitute the sum of the terms and conditions on which property listed in the catalog or
presented for preview both on line and live shall be offered for sale or sold by Winning Run
Auctioneers or an approved auction company affiliated with our network group of Auction
Companies, and any consignor of such property for whom we act as agent. As used herein,
“Winning Run Auctioneers or affiliate,” “we” and “us” refer to Winning Run Auctioneers and
affiliates if applicable.
